"Suicide is a basic fundamental right" said the court, regardless of "whether one has a disease or his age".

Formerly in Germany it was allowed that everybody can get assisted suicide, because this topic was totally unregulated by law, but this was banned by law in 2015 because of various lobbyism of religious groups. Now the constitutional court has lifted the ban on assistance. "Because suicide is a basic right, therefor assisting a basic right can not be considered a crime" they said. It also says that restricting the "right to suicide" by banning certain drugs for a peaceful death and threatening doctors with punishment from prescribing lethal meds is unconstitutional. :happy:

This means that soon Germans can go to a doctor who is willing to prescribe N for a suicide. Of course, it's the doctor who decides who gets the N and who not. It's probably just the people in agony. And surely, now politicians will look ways to restrict the "right of professional suicide", but right now, everybody is entitled. Maybe there will be the 1 doctor who helps also mentally ill people?

Maybe this will be helpful for foreigners as well.

My personal guess is, that politicians will make it very hard to get N, even though the constitutional court has said "everybody is entitled to N as long as you find a doctor who prescribes it". They will make it only for physically severe sick people. Maybe doctor organizations will punish doctors who do it and therefore go around the law...

The court has said that "you have the power to persuade people to not suicide, to change his life circumstances but at the very end, you have to accept his decision and one can not restrict assistance". The court said it's possible to make a "mandatory waiting period" to make sure, the person who suicides is confident and sure about the death wish.

I hope that you guys not from Germany also have a chance. I don't know yet if they will allow foreigners.

It will be prescribed to people that are terminal. If you're in agony from life circumstances, they won't consider that. Don't kid yourself.

Thank you for posting this! Their reasoning sounds good. Of course a lot can be lost in the implementation. I hope they don't find ways to intimidate the doctors, the way docs here in the US can get in legal trouble for prescribing painkillers to people who are in pain. I see they've addressed that by getting it on the record that threatening the doctors is unconstitutional. It looks like a good step forward.

I think germany has the right attitude about a lot of things. That goes for other parts of europe too and the uk decides to leave that instead of the united states

As I just recently said, the pro-life movement is losing the debate in regards to assisted suicide and the right to die. They will eventually lose this war, it's only a matter of time. According to polls, the vast majority of people all over the globe supports the right to die under certain circumstances. It's a large step into the right direction.

I am from Germany and probably tomorrow i will get my final diagnose ALS, my health condition gets worse everyday and im suffering. I really dont want to die, i just want to live my life it was a year ago, im just 34. But be sure you or me wont get N that easy. Now nobody knows what to do and there will be more debats how to handle things now. And afterwards you will need to fill papers, papers,papers, suffer and so. We Germans love debating and dont rush things, and we love fucking office paper fuck.
It wont matter what the court said today.
Maybe people in like 5 or 7 years will profit from today

I don't know, as Elbarado said, Germans love regulating stuff, it will be hard to obtain.

There is profit even for today, because now it's not illegal if you contact a right-to-die organization. They start working again. Maybe you should contact them (Sterbehilfeorganisationen). I don't think it will be easy to get N but in Germany they use inert-gas and Chloroquin-method as well. They used these methods pre 2015, and now we have the same conditions, which is good

I am curious as to what the requirement will be to obtain a prescription. Possibly an extensive history of mental illness as I believe doctors will only provide it on a "last resort" basis.

I think we are still a long way off from mental illness 'counting' as an illness that could be considered for this. Don't get me wrong I'm happy and it's a step in the right direction, but I don't think anything will happen quick enough for my time-frame. Especially since I'm not in the EU anymore lol

The best way would be to circumvent and for us to reject the whole 'mental illness' category, at least for the less serious 'conditions' like depression.

This is a fundamental flaw with the right to die, because almost anyone (terminally ill or physically healthy) who wants to take their own lives can be (forcibly) 'diagnosed' with a mental illness. Heck, almost anyone out of the general population could be held at a mental ward for any diagnosis.
What do they expect? A healthy , happy, functioning, optimistic person wanting to ctb? Even terminally ill people usually aren't happy and optimistic about their fate and thus cou

Let's see what the Sterbehilfe Vereine can do. Maybe they will have their own doctors who are more apt to prescribe N. As I see it (I'm not a law student though), any doctor could prescribe N to anyone requesting it now.

Well at least Germany has approved it your probably end up with a German style Dignitas, think yourself lucky I live in the UK, OMG you could see our politicians with Brexit so you can imagine trying to get it approved here, I will die of old age lol.
